Reverse sack of Secondus, PDP tells Appeal Court

ABUJA – The Peoples Democratic Party, ‎Thursday, asked the Abuja Division of the Court of Appeal to reverse the judgment that sacked its Acting National Chairman, Chief Uche Secondus.

PDP, prayed the appellate court to set-aside the verdict which was delivered by‎ Justice Hussein Baba of an Abuja High Court sitting at Maitama, on December 15.

‎Justice Baba specifically ordered Secondus to vacat‎e Chairmanship seat of the PDP within 14 days.

The court order followed a suit that was filed by the erstwhile Special Adviser to former President Goodluck Jonathan on political matters, Mr. Ahmed Gulak.

The court maintained that evidence before it showed that ‎‎Secondus assumed the headship of the party through an illegitimate process.

Justice Baba agreed with the plaintiff that the position of the Acting National Chairman of the PDP was originally zoned to the North-East geo-political zone of the country and therefore cannot be occupied by Chief Secondus.

‎Consequently, he directed Secondus to within the next two weeks, hand over the leadership of the party to the plaintiff or any other member of the PDP from the North East, who is worthy to pilot the affairs of the party in Acting capacity.

Meanwhile, PDP, yesterday, prayed the appellate court to hold that the high court judge misdirected himself in law by assuming jurisdiction over the matter Gulak lodged before him.

Besides, PDP, through its lawyer, Mr. Emeka Etiaba, SAN, urged the appellate court to not only reverse the sack of its Acting Chairman, but to also strike out the substantive suit.
Gulak had in his suit, challenged the emergence of Chief Secondus as the interim leader of the party.

He prayed the court to sack the defendant, contending that by the provision of the PDP constitution and its zoning principle, he (Gulak), was the proper person to replace the last Chairman of the party, Adamu Muazu, who hailed from the North East geopolitical zone.

Gulak, through his lawyer, Mr. Jibrin Okutepa, SAN, urged the court to dismiss preliminary objections both the PDP and Secondus filed against his suit.

The defendants had earlier challenged the competence of the suit, even as they queried the locus standi of the plaintiff to file same.

Both PDP and Secondus equally challenged the jurisdiction of the high court to meddle in the domestic affairs of a political party.

Already, the party has filed a motion for the stay of execution of the judgement.
