The Court of Appeal sitting in Owerri has nullified the election of Senator Athan Achonu of the Peoples Democratic Party (PDP) representing Imo North Senatorial District in the Senate.
In the lead appeal filed by the Independent National Electoral Commission (INEC) challenging the verdict of the lower tribunal which nullified the election of Senator Achonu, the court dismissed the appeal and upheld the verdict of the tribunal.
Counsel for Accord Party, Barr Uche Wisdom Durueke, explained that the appeal failed largely because of a fundamental slip on the part of INEC of which the court held that it was unjustifiable not to have put the logo of Accord Party on the ballot papers for the said election despite the fact that INEC had duly cleared the party to participate in the election.
The Appeal Court further directed that a re-run election be conducted within 90 days.
Accord Party in the state has reacted to the judgment which nullified the election of Senator Achonu, saying it as an act of God.
Reacting to the judgment, the state Chairman of the party, Elder Ibe ThankGod, described it as a landmark judgment, which has restored the confidence of the common man in the judiciary.
He said the party challenged the outcome of the election at the tribunal because of the brazen injustice meted on the party and its candidate.
