Property tussle: Court orders Kashamu to pay firm N50m daily

The Lagos State High Court in Igbosere has entered judgment against Senator Buruji Kashamu in a landed property tussle.

The court, in a judgement by Justice S.A. Onigbanjo, ordered Kashamu to pay N50m daily to a firm, Lexon Properties Limited, until Kashamu and his company, Kasmal Property Limited, vacate the property in dispute.

 The court said the N50m daily payment would commence from August 14, 2013.

The disputed property, a six-flat building, is said to be located at 1228 Bishop Oluwole Street, Victoria Island, Lagos.

Justice Onigbanjo entered judgment against Kashamu following his failure to appear at a scheduled Case Management Conference in a suit filed against him, his company and the Kano State Government by Lexon Properties Limited.

 The judge, in a January 24, 2018 ruling, which our correspondent obtained, held, “Pursuant to the provision of Order 23 Rule 5 of the High Court Civil Procedure Rules 2012, I find the first defendant’s (Kashamu’s) failure or refusal to attend CMC as scheduled today indicative of their being substantially unprepared to participate in the conference or their failure to participate in the conference in good faith.

“Consequently, I shall enter judgment in respect of appropriate portions of the claimant’s claims against the defendants in line with the provision of the rule of the court.

“Judgment in the sum of N50m daily, commencing from the 14th day of August, 2013, until the defendants yield up possession of the premises subject matter of the suit to the claimant, is hereby entered in the claimant’s favour against the defendant.

“It is further ordered that interest at the rate of 10 per cent per annum be payable on the judgment sum from the 14th August, 2013, until the final liquidation of the judgment sum.”

Our correspondent learnt, however, that Kashamu had filed an application seeking to set aside the judgment.
