A rights advocate Foundation, by name Malcolm Omirhobo Foundation had dragged President Buhari, Justice Mohammed Tanko and others before the Federal High Court, Abuja praying that the purported suspension of Honourable Justice Onnoghen is improper, illegal, unlawful and unconstitutional.

The Applicant via a motion exparte moved by her lawyer Chief Malcolm Omirhobo Esq had prayed the court for an interim order restraining Justice Mohammed Tanko from acting as the Chief Justice of Nigeria pending the determination of a motion on notice filed.
Honourable Justice Chikere of the Federal High Court, Abuja Division in a ruling delivered on February 4, 2019 refused the application and ordered that the Respondents be served within 5 days.
The matter was consequently adjourned to February 12, 2019.
