NASS has no power on election timetable — Prof. Sagay

Professor Itse Sagay

Constitutional lawyer and chairman, Presidential Advisory Committee on Anti Corruption, Prof. Itse Sagay, SAN has berated National Assembly members for reordering the Independent National Electoral Commission, INEC, election time table.

The PACAC chairman premised his submission on the 1959 Independent Constitution till date. According to him, the constitutions have expressly given the electoral bodies powers to organize elections, which included the fixing of time table and dates for elections.

Reacting to the planned veto of the President’s as sent and the controversies generated, the Presidential Adviser stated that the action of lawmakers were illegal and the Independent National Electoral Commission (INEC) should not obey them should they override President Muhammadu Buhari’s veto on the bill.

He described the action of the NASS to re-order the election time table as given by INEC as unconstitutional and self serving. He said since 1956, it has been the responsibilities of INEC or its equivalent to give election time table; therefore this cannot be different.

Asked to comment on the controversies on the altering of the election time table by federal lawmakers and the withholding of assent by President Buhari Sagay said:

“Well, to start with, l don’t want to pride myself that I’m a constitutional lawyer. I think I am among the lawyers, who need to use the constitution. Therefore, I am learning as I am going.

“Now, if you check the provisions of the law in the constitution about this, it says the INEC is to organize, another word I can’t remember now. The second word implies being totally in charge of arrangements of elections.
